Terms of service

Welcome to Lilian Brightly. These Terms of Service ("Terms") govern your use of lilianbrightly.ca (the "Site") and any purchase you make from us. By using the Site or placing an order, you agree to these Terms. Please read them carefully.

1. About us

Lilian Brightly is a small, independently owned jewelry studio based in Calgary, Alberta, Canada. We design and produce handmade sculptural and heirloom jewelry, and we offer a permanent jewelry welding service at markets and private events.

In these Terms, "we," "us," and "our" refer to Lilian Brightly. "You" refers to the person using the Site or placing an order.

2. Eligibility

To place an order with us, you must be at least 18 years old, or have permission from a parent or guardian. By placing an order, you confirm that the information you provide is accurate and that you have the legal authority to make the purchase.

3. Products and pricing

We make every effort to display our products accurately, including colours, materials, and finishes. Because each piece is handmade, slight variations are part of the craft — no two pieces will be perfectly identical.

All prices are listed in Canadian Dollars (CAD) and do not include applicable taxes (GST/PST/HST), which will be added at checkout based on your shipping destination within Canada.

We reserve the right to update pricing, descriptions, and product availability at any time. If a pricing error is identified after an order is placed, we will contact you before fulfilling the order.

4. Made-to-order pieces (Passages Collection)

Pieces in the Passages Collection are made to order. By placing an order for a Storytelling piece, you acknowledge:

Production typically takes 6 to 8 weeks from the date your order is confirmed.
Each piece is crafted specifically for you and is not eligible for refund.
Storytelling pieces may be returned for exchange or store credit only, within 14 days of delivery, in unworn condition and original packaging.
Engraved pieces are final sale and cannot be returned or exchanged.

We will keep you updated by email through the production process.

5. Ready-to-ship pieces (Everyday & Wayfinder Collections)

Everyday pieces are kept in stock and typically ship within two business days. Wayfinder Collection pieces are primarily sold through our retail partners and at markets.

Ready-to-ship pieces may be returned within 14 days of delivery, provided they are unworn and in their original packaging. Return shipping is the customer's responsibility.

All earrings are final sale for hygiene reasons.

6. Engraving

We offer complimentary engraving on eligible Passages Collection pieces, up to 15 characters including spaces. You are responsible for the accuracy of the text you submit. We will engrave exactly what you provide — please review carefully before placing your order.

Engraved pieces are final sale and cannot be returned, exchanged, or refunded.

7. Shipping

We currently ship within Canada only. International shipping may become available in the future.

Complimentary shipping is offered on qualifying orders. Current shipping thresholds and rates are listed on our Shipping & Returns page.
All shipments include tracking.
Title and risk of loss pass to you upon delivery to the carrier.
We are not responsible for delays caused by shipping carriers, customs, weather, or other circumstances beyond our control.

If a package is lost or significantly delayed, contact us and we will work with the carrier to resolve the issue.

8. Returns and exchanges

Our return policy varies by collection. Full details are on our Shipping & Returns page. In summary:

Everyday and Wayfinder Collection: 14-day refund window, unworn, original packaging, customer pays return shipping.
Passages Storytelling Heirloom: 14-day exchange or store credit window only. No refunds.
Engraved pieces and all earrings: Final sale.

9. Permanent jewelry service

Our permanent jewelry welding service is offered at market pop-ups and through private bookings. By participating, you acknowledge:

Permanent jewelry is a fine gold chain welded closed on your wrist, ankle, or neck. It is designed to be worn long-term but can be removed by snipping the chain.
The welding process is safe when performed correctly. You agree to follow any safety instructions provided by Lilian Brightly staff at the time of welding.
We are not responsible for skin reactions, allergies, or injuries that may arise. If you have a known metal sensitivity, please inform us before being welded.
Once welded, the service is complete and non-refundable.
If your chain breaks within 30 days of welding, we will re-weld it at no charge at our next available market or event. After 30 days, a re-welding fee applies.

10. Payment

We accept payment through the methods listed at checkout. Your order is confirmed once payment has been received in full. We reserve the right to refuse or cancel any order at our discretion, including in the case of suspected fraud or payment error.

11. Intellectual property

All content on the Site - including but not limited to product designs, photography, written copy, collection names, product names, the Lilian Brightly name, and logos - is the property of Lilian Brightly and is protected by Canadian and international copyright and trademark law.

You may not copy, reproduce, distribute, or use any content from the Site for commercial purposes without our written permission. You are welcome to share photos of your purchased pieces on personal social media - and we love when you tag us.

12. User conduct

When using the Site, you agree not to:

Use the Site for any unlawful purpose.
Attempt to interfere with the Site's operation or security.
Use automated tools (bots, scrapers) to access or collect data from the Site.
Submit false, misleading, or fraudulent information during checkout or in any inquiry.

13. Communications and consent

By making a purchase, you agree to receive transactional emails related to your order (order confirmations, shipping updates, production updates).

Marketing emails are sent only to customers who have separately opted in through our newsletter signup. You can unsubscribe at any time using the link in any marketing email.

14. Privacy

Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.

15. Limitation of liability

To the fullest extent permitted by law, Lilian Brightly is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Site, our products, or our services. Our total liability for any claim related to a product or service is limited to the amount you paid for that product or service.

Nothing in these Terms limits any rights you have under applicable Canadian consumer protection law, including the Alberta Consumer Protection Act.

16. Indemnification

You agree to indemnify and hold harmless Lilian Brightly, its founder, employees, and partners from any claims or damages arising from your misuse of the Site, your violation of these Terms, or your violation of any applicable law.

17. Changes to these Terms

We may update these Terms from time to time. The most current version will always be posted on this page, with the effective date noted at the top. Continued use of the Site after changes constitutes acceptance of the updated Terms.

18. Governing law

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any dispute arising from these Terms or your use of the Site will be resolved in the courts of Alberta.
